All ex GST and due 14 days from invoice and job completion

Interest accrues on any amount owing after the due date at the rate of 15% per annum, calculated daily from the first day any amount owing becomes overdue and until payment is received.

The Customer shall pay (on a full indemnity basis) any and all expenses, disbursements, collection costs and legal costs which ABCCC has incurred or is liable to pay, in connection with the enforcement of any rights and/or preservation of any rights contained in the agreement.

For the purposes of clause 2 above, the Customer acknowledges that collection costs may be calculated on a commission basis at a percentage rate of up to 20% of the overdue debt and expressly agrees to pay for those expenses as liquidated damages on demand, irrespective of whether (a) ABCCC is not liable to pay the collection agent the commission, until the Customer has made payment of the Customer’s overdue debt (or any portion thereof) and/or (b) the amount of work actually performed by the collection agent before the Customer makes a payment for an overdue debt.

An administration charge of $450.00 applies on each invoice not paid by its due date.

Consequential loss charges will not be accepted.

Turn Away Fees

$250 per person per pump if bookings are not cancelled in writing 12 hours prior to start time.

Collections
-
We are a small service based company so the time taken for any administration that is required to collect any disputed payments will charged at the day rate, for the service we are collecting, as it uses direct productive time and takes staff away from doing productive and billable work. We have to recover these costs.

Invoices

All our invoices are payment claims under the Building and Construction Industry Security of Payment Act 2002.

tinting warranty.

The Brick Fixer through its limited warranty, guarantees that the masonry tinting performed on the specified project will remain colourfast and durable under normal weathering conditions for a period of thirty (30) years (duration may depend on the project). If the masonry tinted by us does not maintain its appearance in relation to adjacent untinted units, The Brick Fixer, will provide the materials and labour to restore the stain to the failed units. Our warranty is solely limited to such corrective action. Any special access equipment required to perform the work would be the responsibility of the client to provide and is not part of the warranty.

The warranty will null and void if the masonry units have been previously treated with silicone, graffiti preventatives, or any other chemical. This would include waterproofing agents or accelerators added to the mortar during mixing. Additionally, this warranty is invalid if the substrate on which we have applied our tints fails of its own accord or has had excessive hydrochloric acid and has an acidic pH or has had hydrofluoric acid-based products such as NoSkum, Active Chemicals Fluortech or Walltech products applied.

brick cleaning warranty.We work to the highest standard and try to eliminate any "sandification" or roughing to the mortar bed pointing polish and the bricks. If we do see a problem we will notify our customers immediately. We warranty our work will meet the quality achieved in our site tests patches or our written agreement for the job .

Prior to doing the work we will may recommend a Barratec beneficiation wash to chemically reset the bricks and mortar. This may also involve additional treatments to balance the pH and others to remove the salts. If this is not done as recommended we will not warranty the work.

Site tests may be required and involve the following:
- Water content of bricks and mortar

Salt analysis - both anions and cations including fluoride

Stain removal

Hardness of mortar

Site protection and damage.

We are usually brought in when things have gone wrong and we provide a recommendation based on a site visit or test to demonstrate our results. During this process we will advise customers about the root cause of their problems and we also explain the potential of damage to a site from the services and products we use. We will test our products and work with customers to protect the site as far as practicably possible based on the testing and on our previous experience but:

We will not be liable for the cleaning, rectifying and the repairing of any previous damage to the property, even on our test areas.

Nor do we accept the responsibility for any unexpected untoward consequences from the reactions that occur from the materials and treatments we use. This is because it is usually impossible to find out exactly what was done before we were engaged and this makes it difficult to predict what will happen when we start our treatments.This is unlimited and it covers the the whole property including but not limited to the following:

Damage due to spray, splatter or runoff from our treatments, as it is impossible to predict and prevent where water and chemicals will run and how they will react with the materials they encounter.
- Removal, repair and cleaning of any part of the property from dirt & dust, removal of rust, stains and damage to bricks and mortar, windows and window frames, flushings, down pipes, door and window fittings and all painted surfaces and metal parts on the property. It includes all internal and external flooring, paths, paving and plants, and the owners personal property left exposed.

We always do our best to predict, test and advise customers about the potential of collateral damage and provide practical prevention strategies, but it is the customers sole responsibility to cover the cost of preventing and rectifying any collateral and other damage on site.

Should any further studies, cleaning fixing and treatments be required based on our site investigations or work, these will be the sole responsibility of our clients.

After treating we will rinse and clean treated areas and any areas nearby if we deem it appropriate.

Only at our sole discretion, will we agree to remediate collateral and other damage.

Will will not be liable for any unexpected consequential loss.

Please Note: We clean bricks with Barratec a product that is a safe green environmentally acceptable acid. It has DuPont and Akso paint approval and is used to clean concrete trucks. It will not damage paint, stain bricks nor will it damage mortar.

If you accept our quotes or agree to use our services then the above conditions apply and will override any previous contracts and communications, written or verbal and this includes customer purchase order conditions.
